日本体育法学的发展及研究动向

摘要：20世纪60年代以来，日本体育法学的发展大致经历了3个阶段。第一阶段，从20世纪60年代初期到70年代末期，为起步阶段。以体育振兴法的研究为契机，学者们开始关注体育与法的研究，打破了以往“法不介入体育”的传统观念，日本体育法学开始兴起。第二阶段，从20世纪80年代初期到90年代初期，为快速发展期。学者们不仅关注体育法学某一领域的研究，并且开始探究体育法学学科的理论体系。第三阶段，从20世纪90年中期到现在，为学科形成期。日本的体育法学已经具有明确的研究对象、研究方法和比较系统的知识体系，从而将体育法学提高到了“学”的水平。体育法学学科的性质、国民体育权利、体育事故与救济、职业体育与法、国际体育法5个方面是日本体育法学界普遍关注的主要问题。

The development and research trend of sports law in Japan

Abstract:The development of sports law in Japan has gone through approximately 3 stages since the 1960s.The first stage is the beginning stage ranging from the early 1960s to the late 1970s,at which the scholars started to focus on the study of sport and law based on the study of sports promotion law as the turning point, going beyond the previous traditional conception of “law won’t involve in sport”, and sports law in Japan began to boom. The second stage is the rapid development period ranging from the early 1980s to the early 1990s,in which the scholars not only focused on the study of sports law in a certain area, but also started to explore a theoretical system for sports law subject. The third stage is the subject forming period ranging from the mid 1990s to now, in which sport law in Japan has had clear research object, research method and knowledge system of comparison system, thus promoting sports law to the level of “science” .In the mean time, the author introduced major issues focused on by sports law community in Japan in 5 aspects, namely, the nature of sports law subject, civilian’s sports right, sports accident and relief; professional sport and law, and international sports law.
