论中国武术的知识产权保护 吕昊

(中国政法大学 民商经济法学院，北京102200) 摘要：中国武术作为一种智力成果迫切需要知识产权法的保护。正确认识中国武术的性质是厘清如何对中国武术予以知识产权保护的前提。从体育性和传统知识性的角度，中国武术能够受到来自于著作权、未公开信息、传统知识和证明商标的保护。我国现行的知识产权法律存在缺陷，必须修改《著作权法》，制定专门保护传统知识的法律或者针对中国武术专门立法，通过司法实践，将竞技武术技战术中的先进技术、训练和恢复方法以及健身武术中的一些“养生之法”确立为一种未公开信息。 关键词：中国武术； 知识产权； 著作权； 未公开信息； 传统知识 中图分类号：G852文献标识码：A文章编号：1006-7116(2006)04-0141-04

On the protection of intellectual property of Chinese Wushu Lü Hao

(College of Economic Law,China University of Politic Science and Law,Beijing 102200,China) Abstract:Chinese Wushu (martial arts) as a sort of intellectual achievement urgently needs to be protected by the intellectual property law. Correctly recognizing the nature of Chinese Wushu is the precondition for clarifying how to provide intellectual property protection to Chinese Wushu. From the perspective of sports nature and traditional knowledge nature, Chinese Wushu can be protected in terms of copyright,undisclosed information, traditional knowledge and certified trademark.There are defects in the intellectual property law currently effective in China.In order to protect Chinese Wushu properly,the Copyright Law must be revised,and a law dedicated to the protection of traditional knowledge or a legislation dedicated to Chinese Wushu must be established,so as to establish the advanced techniques as well as training and recovery methods in competitive Wushu techniques and tactics and some “health care methods” in fitness Wushu as a sort of undisclosed information by means of juridical practice.
