| 1.Research Institute of Sports Law，Tianjin Institute of Physical Education，Tianjin 300381，China；2.Hebei Institute of Physical Education，Shijiazhuang 050041，China） Abstract: The authors clarified that the nature, connotation and attribute of sports rights are the precondition and foundation for the legislation, execution and application of sports laws as well as for law study and communication. The authors drew the following conclusions：international sports documents are the source for sports rights; essen-tially sports rights are the freedom and interests that should be owned by people in the process of accepting physical education and participating in physical exercise; sports rights are composed of two core subsidiary rights, namely, physical exercise right and physical education right；In China sports rights belong to social cultural rights in general, and currently presumed rights；sports rights have all the attributes of a basic right.Corresponding system design should be carried out for the revision of sports legislation and the Sports Law in China, while in practice corre-sponding resource allocation should be made based on the undertaking of nationwide fitness as the fundamental goal and value orientation.
