摘      要：体育领域存在着大量“软法”，包括体育政策、体育行业组织规则、体育专业标准、体育惯例。体育治理出现“硬法”软化和“软法”硬化现象，它们各有利弊。其中不能容忍的是“软法”与“硬法”的抵触，为此，应该不断提升“软法”理性。在体育法治精神指导下，构建“软硬兼施”的体育治理模式，软硬法两者功能上相辅相成，各有分工与协作。

Abstract: In the sport area there are a lot of “soft laws”, whose main carrier forms include sport policies, sport in-dustrial organizational regulations, specialized sport standards and sport practices. In sport government, there are the signs of “hard laws” softening and “soft laws” hardening, which have their own advantages and disadvantages. What is intolerable therein is the contradiction between “soft laws” and “hard laws”; therefore, the rationality of “soft laws” should be constantly enhanced. A “soft laws and hard laws concurrently implemented” sport government mode should be established under the guidance of the spirit of sport government by law, so that soft laws and hard laws can supplement each other in terms of functions, and do their own jobs respectively.
