摘      要：要解决竞技体育中贿赂行为的定罪争议，其唯一途径是明确相关人员的主体身份：国家体育总局中从事公务的人员是国家机关工作人员；全国单项体育协会中从事公务的人员和裁判员，以“国家工作人员”论；职业体育俱乐部中的教练员、运动员是企业的工作人员。

Abstract: The only way to settle disputes about the conviction of briberies in competitive sports is to clarify the subject identification of related personnel: personnel engaging in public affairs in the State Sports Administration are personnel working for a state organization; personnel engaging in public affairs in Single Event Sports Associa-tions nationwide are “other personnel engaging in public affairs legally”, regarded as “personnel working for the state”; referees are “other personnel engaging in public affairs legally”, regarded as “personnel working for the state”; coaches and athletes in professional sports clubs are personnel working for an enterprise.
