(1.Department of Social Sports,Tianjin University of Sport,Tianjin 300381,Chian;2.School of Physical Education,South China Normal University,Guangzhou 510006,China) Abstract: On the basis of comparing related legal systems of European and American countries, the authors con-cluded that professional sports clubs are obligated to ensure professional athletes’ labor rights with a freedom right attribute, and to rationally ensure professional athletes’ labor rights with a social right attribute, such as rest and va-cation, safety and sanitation, participation in competitions as national representatives etc. Associating with actual circumstances of China, the authors put forward some suggestions, such as professional athletes should be given the right to change their owners more freely since the basic legal status of professional athletes is laborer.
