(Law School,Xiangtan University,Xiangtan 411105,China) Abstract: According to the Olympic Charter, the International Olympic Committee has the power to decide to impose a membership suspension or cancellation penalty on a National Olympic Committee, however, the existing stipulations are obviously in favor of the International Olympic Committee exercising its power, yet seriously neglecting the protec-tion of the rights of National Olympic Committees. The membership of the Indian National Olympic Committee being suspended is the latest instance up to this day; the power of the International Olympic Committee and its executive committee to punish National Olympic Committees should be somewhat regulated; the procedural and substantive rights of National Olympic Committees need to be ensured; disputes occurring in the process of punishment should be submitted to and settled by the Court of Arbitration for Sport.
